If you want to authenticate a Picasso you have to contact the Picasso Administration.

It's opinion bears the name of Claude Picasso, claiming to his moral rights.
In the name of the Picasso admin, He say if a work is by his father or not, claiming to his eye and the relation to him...

Well, maybe we can accept that he had a close relation to the artists, but in a recent interview his mother Francoise Gilot, explains a few facts:

1.- Claude was born in 1947, when he was 6 years old his mother and Picasso Broke...

2.- In 1964 (when Claude was 17 or 16 if we take his mother's word) they ended any relation with his father.

3.- Claude and Paloma were not allowed to assist Picasso's burial (Picasso's asked Jacqueline to denied the access).

4.- The last time Claude Picasso saw his father he was 16 or 17 years old.

How can Claude be an expert in his father's work claiming his near relation to him?

 


I HAVE a good relation with my father actually (he stills among us...) but I am unable to tell
you what he did in the 70's or 80´s and if you present me something done by him (or not)
I would not been able to...

Even if I recall my close relation or the mysticism inside my DNA chain or any other absurd nonsense..

Widmaier v Spadem & Others
This case concerned the exercise of copyright and moral rights by the heirs of Pablo Picasso. The French Supreme Court was asked to consider how the management of the right to exploit and reproduce the works of Picasso was to managed when vested indivisibly in his heirs. Initially the heirs entrusted the management of their right to the SPADEM association (Societe de la Propriete Artistique et des Dessins et Modeles). One of the heirs, Mrs Widmaier, subsequently notified SPADEM that she was withdrawing its management authority. Two of the other joint owners brought an action against her for the appointment of an agent to administer the undivided rights in the common interest.

The appeal court upheld the order of the President of the Tribunal de Grande Instance, Paris, who appointed one of the heirs as administrator of the undivided estate, ruled that he should have authority to instruct SPADEM on before of the estate and prohibited Mrs Widmaier from carrying out any acts of administration or disposition whatever in respect of the copyright or moral rights attaching to Picasso's works. The Court considered that Mrs Widmaier's rights were not being changed but merely safeguarded in the general interest of all the heirs until they could be severed and transferred to her outright.

Dealing with Authenticity under the  Droit Morale:

The pivotal point in dealing with works under possible Droit Morale is to establish if the artist is deceased. If he or she is not, the problems of Droit Morale do not operate because the artist is producing and hence the work is authentic. If the artist is deceased the following steps are recommended:

  1. Determine who are the rightful heirs and assignees, and do a background check on them. If they are notorious publishers of posthumous works, consider walking away.
  2. If the work was produced prior to death, ask how it was attributed. Non- scholarly attributions are unacceptable.
  3. If a Certificate of Authenticity is presented by assignee or heir and signed by either one, consider that the COA is worthless.
  4. If the work is signed after the artist is deceased it is a legal fraud.
  5. Pay particular attention to the wording of the documents relating to the work. Be suspicious of equivocating language.
  6. Although famous works are discovered after the death of the artist, such discoveries usually turn out to be of questionable authenticity. Be wary of the newly discovered work from the heirs or assignees especially when there is a Home Depot imprint on the back of the canvas.
